GENERAL TERMS AND CONDITIONS

PURPOSE AND SCOPE OF APPLICATION

These general conditions of contracting and use (hereinafter “General Conditions”) govern the sale of products and services of JOELO 2006, S.L., (hereinafter “the owner”), directly to the customer, through the website https://staging.weveproject.com/. The customer is understood to be both the consumer and user according to the legal concept of the same established by the General Law for the Defence of Consumers and Users, as well as the businessperson or professional natural or legal person. In cases where any of these general conditions or part or all of their regulation refers only to consumers and users, or only to businessmen or professionals, this will be specifically indicated.

Both browsing the online shop and the purchase of any of the products or services offered therein imply the acceptance by the customer, without reservations of any kind, of each and every one of these general conditions of contracting and use, the customer being bound by them.

The owner may modify the website and these terms and conditions to make any changes and modifications it deems appropriate and necessary for the proper functioning of the same, without prior notice.

JOELO 2006, S.L. (the owner), is a trading company duly constituted with registered office in Igualada (08700), Calle Gran Bretaña, number 11, and which is duly registered in the Companies Register of Barcelona, volume 34480, folio 104, page B-328017, with tax identification number B64172042.

PRODUCTS AND SERVICES

JOELO 2006, S.L., through its website https://staging.weveproject.com/ and online shop, is dedicated to the distribution and sale of sports fashion of the sustainable and athleisure brand WEVE and its complementary activities.

LEGAL CAPACITY TO CONTRACT

The user declares that he/she is of legal age (over 18 years old) and that he/she has the necessary legal capacity to contract the products and services offered by JOELO 2006, S.L., declaring that he/she accepts the binding nature of this agreement and fully understands and accepts the conditions announced here for the use of the website and the services offered.

In the event of contracting by minors, the authorisation of the parents or legal guardians will be required. The owner is not responsible for the veracity and accuracy of the data filled in by the user and, therefore, cannot verify the age of the same.

ORDERING AND PRODUCT AVAILABILITY

The information contained in these Conditions and the details contained in this website do not constitute an offer to sell, but an invitation to contract. No contract will exist between you and us in relation to any product until your order has been expressly accepted by us. If your offer is not accepted and your account has already been debited, you will be refunded in full.

In order to purchase the products, you must follow the online purchase procedure. On the website, the customer must register as a user of the website by filling in the corresponding electronic form or, if you do not wish to register, in order to place the order you will be asked to provide an email address. Before or after registration, the customer must add the products to the basket by filling in the order form and validating it. The customer can add and remove products from the basket during the purchase process. The order is formalised at the moment the customer accepts the order by activating the PAY button, which appears at the end of the purchase request, after accepting the legal terms and general conditions of sale. The electronic documents formalising the contract will be filed by the holder and will be accessible.

At the time of placing the order, the customer assumes knowledge of the particular conditions of sale (characteristics, price, quantity, measurements, quality of the product, etc.) and expressly accepts them without reservation. The fact of placing an order on the website https://staging.weveproject.com/ implies acceptance of the prices, the description of the articles and the general conditions of sale.

Notwithstanding the above, and even if the owner of https://staging.weveproject.com/ has received the purchase order from the customer, the owner of the website, within a maximum period of twenty-four (24) working hours, will send confirmation of the purchase by e-mail to the customer, detailing the products purchased, their characteristics, prices and total amount. This confirmation received by e-mail is proof of purchase. If the customer does not agree with the information contained in the confirmation email, he/she may request, within twenty-four (24) hours, the modification of the information or the cancellation of the contract.

Your purchase is subject to availability, with the limits of available stock, so that if a product is out of stock, unavailable or cannot be produced, the customer will be informed of this situation at the time of placing the order.

DELIVERY METHODS AND DELIVERY TIMES

Orders will be delivered to the delivery address specified by the customer at the time of placing the order. 

The holder assumes no liability in the event that the data provided by the customer is inaccurate or incomplete or the delivery could not be made for reasons beyond the control of the delivery company, assigned for this purpose, such as the absence of the addressee.

Home delivery:

Deliveries will be made by various logistics operators depending on the weight and volume of the orders. The delivery time varies according to the type of product, its availability, the destination, the type of shipment selected and the time of receipt of the order. The maximum delivery time is fourteen (14) calendar days from confirmation of payment, in the case of products produced, available and in stock. No deliveries will be made on Saturdays, Sundays or public holidays. These are estimated delivery times that may vary due to logistical reasons or force majeure. If for any of these reasons it is not possible to meet the scheduled date, the customer service department will inform the customer as soon as possible. Delays in delivery do not imply the cancellation of the order or the right to compensation. 

The order may be tracked by means of the shipment reference code that the customer will receive by e-mail, provided that the logistics operator has this code and provides it, in order to be able to track the package on the carrier’s website.

SHIPPING COSTS AND RECEIPT OF ORDERS

Shipping costs are free of charge throughout the European Union and the United Kingdom. For deliveries to other countries, please contact the e-mail address info@staging.weveproject.com.

The customer undertakes to sign the receipt form presented by the carrier upon delivery, acknowledging receipt of the number of packages indicated. If the customer detects damaged products or damage during transport (open packages, knocks, broken packaging, etc.), he/she must refuse the package, indicating this on the receipt form and informing the owner as soon as possible, in any case within fourteen (14) calendar days, by e-mail to info@staging.weveproject.com or by telephone on +34 608 50 25 60. Outside this period, returns of damaged products or claims for missing products will not be accepted.

PRICES

The price of the articles is indicated in euros (EUR) including VAT, but does not include other applicable taxes in force on the date of acceptance of the offer, which will be added to the total amount of the order.

The corresponding shipping costs are always indicated in the order.

The owner reserves the right to make changes to the website at any time and without prior notice, as it deems appropriate, and may update products on a daily basis depending on the market.

Within seven (7) days of receipt of the confirmation e-mail by the customer, the holder shall make the corresponding invoice available to the customer on the website for downloading in PDF format, without prejudice to the consumer’s right to receive the invoice in paper format.

CUSTOMS INFORMATION

In the event of placing an order that will be delivered to a country outside the European Union, import duties and taxes may be payable by the purchaser and will be payable when the package arrives at its destination. In addition, the purchaser shall be responsible for any additional amounts that may be incurred due to customs clearance. From the moment the purchase is made, you acquire the status of importer and therefore you must comply with all laws and regulations applicable to the country in which you receive the product.

PAYMENT METHOD

Customers must pay for orders in advance, prior to shipment. Purchases may be paid for by any of the following methods:

Debit or credit card payment:

  • VISA
  • MASTERCARD

Payment by BIZUM system:

  • To make the payment by means of the BIZUM system, it is necessary for the user to connect to their bank, in the BIZUM section. From there, the user must enter the telephone number associated with the service and the password for BIZUM online purchases (if the user does not have this password, it can be requested from the user’s bank).

The user will receive an SMS with a confirmation code that must be entered in the payment window and finalised.

The user must pay the fee associated with the use of this service.

The possibility of using this service is subject to the availability of each bank to make online purchases through the BIZUM system.

The owner shall retain ownership of the products in the order until full payment has been made by the customer.

The owner of the domain may modify the payment methods, duly stating this.

In order for JOELO 2006, S.L. to carry out the appropriate procedures, the customer shall notify the company as soon as possible of any undue or fraudulent charge. This notification may be sent to the e-mail address or by calling the telephone number indicated above.

RIGHT OF WITHDRAWAL AND REFUND

In the exclusive case of natural person, who has the status for the purposes of Royal Legislative Decree 1/2007, of 16 November, of final consumer, the customer will have a period of fourteen (14) calendar days, counted from the date of receipt of the product for the return of the same, being assumed by the customer the processing and shipping costs, except error of the owner of the domain. The product to be returned must retain its original characteristics intact and in perfect condition, be presented in the original packaging, with all its accessories and documents and without having been used or consumed. 

In order to exercise the right of withdrawal, the owner makes the withdrawal document available to the customer, which can be downloaded here. Products must be returned to Calle Gran Bretaña, 11, 08700 – Igualada from Monday to Friday from 7 am to 7 pm. The customer must return the product with its original packaging and accessories and a copy of the proof of delivery and, in any case, the invoice issued by JOELO 2006, SL or the receipt form, together with the completed cancellation document. The holder will refund the amount paid in the same way in which the purchase was paid, as soon as possible, before fourteen (14) calendar days have elapsed from the date on which JOELO 2006, S.L. received the product and has been able to verify that it is in the state or condition previously established. In the event that the returned product is not in the state or condition stated above, the owner will not refund the amount paid.

GUARANTEE

JOELO 2006, S.L. guarantees the quality of the products for the legally established period from the date of delivery. In the event that a product is defective, JOELO 2006, S.L. will repair or replace the product or terminate the contract if the claim is made within the legal period. However, the guarantee will not be valid if there are deficiencies or damage due to improper or negligent use or handling, lack of maintenance or care, or due to wear and tear caused by normal use of the product. If the customer considers that the product does not meet the characteristics or has defects, he/she should send an e-mail to info@staging.weveproject.com indicating his/her details, invoice number and the anomaly or fault detected. JOELO 2006, S.L. may request that a photo of the defects be sent. The products will be considered to conform to the contractual characteristics if they conform to the description detailed by JOELO 2006, S.L. and to the specific quality, being suitable for the use for which this type of product is intended. If you wish to claim the guarantee of a JOELO 2006, S.L. product, please contact the customer service department at info@staging.weveproject.com.

In the event that the customer is a businessman or acts within the framework of his business or professional activity, the provisions of the Commercial Code will apply.

RESPONSIBILITIES OF THE CUSTOMER

The customer undertakes to make lawful use of the products, without contravening current legislation or infringing the rights and interests of third parties.

The customer guarantees the truthfulness and accuracy of the data provided when filling in the contracting forms, avoiding causing damage to JOELO 2006, S.L. as a result of their incorrectness.

PERSONAL DATA

JOELO 2006, S.L. will process the data provided by the customer in accordance with the Privacy Policy which can be consulted at the following link: Privacy Policy.

LANGUAGE

Regardless of the possible translations of these general terms and conditions of sale, the official language of the contract will always be the Catalan version. 

JURISDICTION AND APPLICABLE LAW

In the event of conflicts in the interpretation or application of these contractual conditions, in the case of end consumers, in accordance with the applicable regulations, the courts of the place of fulfilment of the obligation or those of the domicile of the purchasing party shall have jurisdiction.

In the case of a purchase made by a company, both parties submit, expressly waiving any other jurisdiction, to the Courts and Tribunals of Igualada (Barcelona).

EXCHANGES AND RETURNS

Changes:

You have 15 business days, from the moment you receive the package, to notify the return or exchange of your order for FREE and at home.
After notification, you have an additional 15 days to send the exchange or return.
Returns:

Changes can be made for size, color, or product of the same category.
The first change is free. If a second exchange is desired, the customer assumes the shipping costs.
Once the change is requested through this
form, the delivery person will pick up the unwanted item and deliver the requested item.
Once the return is requested, the delivery person will pick up the package at the indicated address and will take the shipping label.
The refund will be made when the product arrives at our offices.
The refund will be made through the same payment method used for the purchase.
